Agreement and eligibility
These Terms govern access to and use of Smarlist websites, products, waitlists, applications, and related services. By using Smarlist, you agree to these Terms.
You must have authority to accept these Terms for yourself or the organization you represent. If you do not agree, do not use the services.
Accounts and acceptable use
You are responsible for maintaining the confidentiality of account credentials and for activity under your account.
You may not misuse Smarlist, interfere with the service, reverse engineer restricted parts, submit unlawful content, infringe third-party rights, attempt unauthorized access, or use the service to deceive customers.
AI outputs and merchant responsibility
Smarlist may generate store structures, product copy, pages, checklists, policies, and other outputs using AI. AI outputs may be inaccurate, incomplete, or unsuitable for your specific business.
You are responsible for reviewing all outputs before publishing, including product claims, pricing, taxes, shipping, legal compliance, privacy notices, payments, fulfillment, customer support, and advertising claims.
Intellectual property
Smarlist and its technology, design, branding, and software are owned by Smarlist or its licensors. You may not copy or exploit them except as allowed by the service.
You retain rights to your own input content, subject to the rights needed for Smarlist to provide, secure, and improve the service.
Disclaimers and limitation of liability
Smarlist is provided as is and as available to the fullest extent permitted by law. We do not guarantee uninterrupted service, specific revenue, search ranking, conversion rate, legal compliance, or business outcome.
To the fullest extent permitted by law, Smarlist will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, or goodwill.
Changes and termination
We may update the service and these Terms over time. Material changes will be communicated by reasonable means.
We may suspend or terminate access if you violate these Terms, create risk, or use the service unlawfully. Some provisions continue after termination where their nature requires it.
